Terms of Service

These Terms of Service (“Terms”) govern your use of the SecondShift platform operated by SecondShift (“we”, “us”, “our”). By creating an account or using the platform, you agree to these Terms.
1. About SecondShift
SecondShift is a cloud-based software platform that helps allied health clinics in Australia with administrative tasks including report writing, standardised assessment scoring, and clinical documentation. SecondShift is not a clinical tool and does not provide clinical advice.
2. Eligibility
The platform is designed for use by registered allied health practitioners and authorised clinic staff in Australia. By creating an account, you represent that you are authorised to use the platform on behalf of your clinic.
3. Your account
You are responsible for maintaining the security of your account credentials. You must not share your login details with others. You are responsible for all activity that occurs under your account.
Each user must have their own account. Clinic owners can invite practitioners and administrative staff to join their clinic on the platform.
4. Your data
You retain ownership of all data you enter into the platform, including client information, session notes, documents, and reports. We do not claim ownership of your data.
You grant us a limited licence to process your data solely for the purpose of providing the platform services (report generation, assessment scoring, document storage, email delivery).
You are responsible for ensuring you have appropriate consent to enter client/participant information into the platform, in accordance with the Privacy Act 1988 and any applicable professional or regulatory obligations.
5. Clinical responsibility
SecondShift is an administrative tool, not a clinical decision-making system. All reports generated by the platform are drafts that require practitioner review and approval before use.
The practitioner who approves a report assumes full clinical responsibility for its content, accuracy, and appropriateness. SecondShift does not provide clinical advice, diagnosis, or treatment recommendations.
Assessment scoring (e.g. CELF-5) is performed using published normative tables and deterministic algorithms. While we strive for accuracy, the practitioner is responsible for verifying scores and clinical interpretations before use in clinical decision-making.
6. AI-generated content
SecondShift uses artificial intelligence to generate report drafts and email content. AI-generated content:
- Is always presented as a draft for human review
- Must be reviewed and approved by a qualified practitioner before being sent or used
- May contain errors, omissions, or inaccuracies
- Should not be relied upon as a substitute for professional clinical judgement
7. Acceptable use
You agree not to:
- Use the platform for any purpose other than legitimate allied health administration
- Enter false or fabricated clinical information
- Attempt to access data belonging to other clinics
- Reverse-engineer, copy, or redistribute the platform or its components
- Use the platform in any way that violates applicable Australian law or professional standards
- Share access credentials or allow unauthorised users to access the platform
8. Service availability
We aim to provide reliable access to the platform but do not guarantee uninterrupted availability. The platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
During the beta period, features may change, be added, or be removed without notice. We welcome feedback to help improve the platform.
9. Beta programme
SecondShift is currently in beta. During the beta period:
- The platform is provided free of charge
- Features and functionality may change without notice
- We may limit the number of users or clinics
- We appreciate feedback and bug reports to help improve the platform
We will provide reasonable notice before transitioning to paid pricing, and beta users will be offered favourable terms.
10. Intellectual property
The SecondShift platform, including its design, code, algorithms, and documentation, is the intellectual property of SecondShift. Your use of the platform does not transfer any intellectual property rights to you.
Reports and documents generated using the platform belong to you (the clinic). The underlying templates, scoring algorithms, and AI models remain our property.
11. Limitation of liability
To the maximum extent permitted by Australian law:
- SecondShift is provided “as is” without warranties of any kind
- We are not liable for clinical decisions made based on platform-generated content
- We are not liable for indirect, consequential, or incidental damages arising from use of the platform
- Our total liability is limited to the fees you have paid for the platform in the 12 months preceding the claim
Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
12. Termination
You may close your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms or if continued use poses a risk to the platform or other users.
Upon termination, you may request an export of your data. We will retain data as required by Australian healthcare record-keeping laws.
13. Changes to these Terms
We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
